SCOPE OF APPLICATION
These Terms and Conditions of Use apply to westpoint-group.com ("Site") and partner.westpoint-group.com ("Partner Portal"). The specific rules for the Portal are specified in Chapter B.
CHAPTER A — PUBLIC SITE
ARTICLE 1 - PURPOSE AND ACCEPTANCE
The Site westpoint-group.com aims to present the company GLADIUS FRANCE (trade name Westpoint Group) and its activities, to display a selection of home appliances for informational purposes, and to allow users to contact us.
Important: The Site is an informational catalog. No sales are made directly on the Site.
Using the Site implies full acceptance of these Terms and Conditions. Users who do not accept to be bound by these Terms and Conditions must not use the Site.
ARTICLE 2 - DEFINITIONS
In these Terms and Conditions, the following terms have the meaning given below:
- "Site": refers to the website accessible at westpoint-group.com
- "Publisher" or "We": refers to GLADIUS FRANCE, the Site publisher
- "User" or "You": refers to any natural or legal person who accesses and navigates the Site
- "Content": refers to all information, texts, images, videos, data present on the Site
- "Services": refers to all services offered on the Site
- "Wishlist": refers to the functionality allowing to save a list of favorite products
ARTICLE 3 - SERVICES OFFERED
The Site offers the following services:
- Present the company GLADIUS FRANCE (trade name Westpoint Group) and its activities
- Display a selection of home appliances for informational purposes
- Allow users to contact the company
- Offer newsletter subscription
- Provide the ability to create a product wishlist
Important: The Site is an informational catalog. No sales are made directly on the Site.
ARTICLE 4 - SITE ACCESS
4.1 Access Conditions
The Site is accessible free of charge to any User with Internet access. All costs related to accessing the Site, whether hardware, software or Internet access fees, are exclusively borne by the User.
4.2 Availability
The Publisher strives to allow access to the Site 24 hours a day, 7 days a week, except in cases of force majeure or events beyond the Publisher's control.
The Publisher reserves the right to:
- Suspend, interrupt or limit access to all or part of the Site for maintenance reasons
- Modify or permanently discontinue the Site or its services
The Publisher cannot be held responsible for inability to access the Site.
ARTICLE 5 - SITE USE
5.1 Compliant Use
The User undertakes to use the Site in accordance with these Terms and Conditions and applicable legislation. In particular, they commit to:
- Not use the Site for illegal or unauthorized purposes
- Not disrupt or interrupt the Site's operation
- Not attempt to access parts of the Site without authorization
- Not introduce viruses or any other malicious code
- Respect intellectual property rights
5.2 User Behavior
The User undertakes to:
- Provide accurate and up-to-date information when using forms
- Not impersonate another person
- Not collect or store personal data of other users
- Not use robots, spiders or other automated means to access the Site
ARTICLE 6 - DETAILED FEATURES
6.1 Product Catalog
The Site presents a selection of home appliances for purely informational purposes. Information about products (features, prices, availability) is provided for guidance and may be changed without notice.
Products presented are not sold directly on the Site. For any purchase, the User is invited to contact GLADIUS FRANCE via the contact form.
6.2 Contact Form
The contact form allows Users to send messages to GLADIUS FRANCE. The Publisher strives to respond as quickly as possible but does not guarantee a specific response time.
6.3 Newsletter
Newsletter subscription is optional and requires explicit consent from the User. The User can unsubscribe at any time via the unsubscribe link present in each newsletter.
6.4 Wishlist
The wishlist feature allows saving a list of favorite products. This list is stored only locally on the User's device (browser localStorage). The wishlist can be deleted at any time by the User by clearing their browser cache.
6.5 Partner Map
The Site offers an interactive map presenting our partners. This functionality uses:
- OpenStreetMap : OpenStreetMap: for cartographic data (free and open data)
- Leaflet : Leaflet: JavaScript library for interactive display
- Stadiamaps.com : Stadiamaps.com: for satellite and cartographic tiles
The User may optionally authorize access to their geolocation to improve their search experience. This authorization:
- Is entirely voluntary and can be refused
- Can be revoked at any time via browser settings
- Does not involve any storage of GPS coordinates on our servers
- Serves only to suggest the nearest partners
ARTICLE 7 - INTELLECTUAL PROPERTY
7.1 Publisher's Rights
All Site Content (texts, images, videos, logos, trademarks, databases, software, etc.) is protected by French and international laws relating to intellectual property.
Unless otherwise stated, all intellectual property rights on the Content belong exclusively to the Publisher or its partners.
7.2 License of Use
The Publisher grants the User a limited, non-exclusive, non-transferable and revocable license to:
- Access the Site and view the Content for personal and non-commercial purposes
- Print Site pages for personal use
7.3 Prohibitions
It is strictly forbidden to:
- Reproduce, copy, sell or exploit all or part of the Site for commercial purposes
- Modify, adapt, translate or create derivative works from the Content
- Extract or reuse a substantial part of the database
- Use the Content in a manner that could harm the Publisher's rights
ARTICLE 8 - PERSONAL DATA
The collection and processing of personal data are governed by our Politique de Confidentialité et notre Politique de Cookies, qui font partie intégrante des présentes CGU.

ARTICLE 9 - LIABILITY
9.1 Limitation of Liability
The Publisher does not guarantee that:
- The Site will operate without interruption or error
- Defects will be corrected
- The Site or server are free from viruses or other harmful components
The Publisher cannot be held responsible for direct or indirect damages resulting from:
- Use or inability to use the Site
- Unauthorized access or alteration of your transmissions or data
- Statements or behavior of third parties on the Site
- Any other matter relating to the Site
9.2 Accuracy of Information
The Publisher strives to provide accurate and up-to-date information but does not guarantee the accuracy, completeness or timeliness of information published on the Site.
Product information is provided for guidance and may contain errors. The User is invited to verify information before making any decision.
9.3 External Links
The Site may contain links to third-party sites. The Publisher exercises no control over these sites and disclaims all responsibility for their content or use.
ARTICLE 10 - INDEMNIFICATION
The User undertakes to indemnify and hold harmless the Publisher, its officers, employees and partners against any claim, loss, damage, cost or expense (including attorney fees) resulting from:
- Their violation of these Terms and Conditions
- Their violation of third-party rights
- Their inappropriate use of the Site
ARTICLE 11 - MODIFICATIONS TO TERMS AND CONDITIONS
The Publisher reserves the right to modify these Terms and Conditions at any time. Modifications take effect upon publication on the Site.
Users are advised to regularly consult the Terms and Conditions. Continued use of the Site after modification constitutes acceptance of the new Terms and Conditions.

ARTICLE 12 - DURATION AND TERMINATION
These Terms and Conditions apply for the entire duration of use of the Site by the User.
The Publisher reserves the right to:
- Suspend or terminate access of any User who violates these Terms and Conditions
- Take any appropriate measure to enforce the Terms and Conditions
ARTICLE 13 - PARTIAL INVALIDITY
If one or more provisions of these Terms and Conditions are deemed invalid or unenforceable, the other provisions remain in force and retain their full effect.
ARTICLE 14 - NON-WAIVER
The Publisher's failure to exercise a right or require performance of an obligation under the Terms and Conditions does not constitute a waiver of that right or obligation.
ARTICLE 15 - FORCE MAJEURE
The Publisher will not be liable for failure to perform its obligations in case of force majeure, particularly in case of:
- Natural disaster
- War, terrorism, riot
- Strike, lockout
- Pandemic
- Power failure or telecommunications network failure
- Computer hacking act
ARTICLE 16 - APPLICABLE LAW AND JURISDICTION
16.1 Applicable Law
These Terms and Conditions are governed by French law, without prejudice to mandatory consumer protection provisions applicable in the User's country of residence.
16.2 Dispute Resolution
In case of dispute, the User is invited to contact the Publisher to seek an amicable solution.
For consumers residing in the European Union:

16.3 Competent Jurisdiction
Failing amicable settlement, any dispute will be submitted to competent courts in accordance with common law rules.
For professionals: the courts of Bordeaux will have exclusive jurisdiction.

ARTICLE 18 - ACCESSIBILITY
The Publisher is committed to making the Site accessible to as many people as possible, in accordance with web accessibility standards. If you encounter difficulties accessing the Site, please contact us so we can assist you.
CHAPTER B — PARTNER PORTAL (B2B)
B.1 PURPOSE AND ACCESS
The Partner Portal is a reserved B2B space, providing access to our complete range of products, prices and technical documents. No public registration is offered: accounts are created by Westpoint and communicated to the partner.
B.2 PORTAL TERMS ACCEPTANCE (PROOF)
Access to the Portal is subject to acceptance of these Terms and Conditions (Chapter B) by the Partner User. At first login, the User must check "I have read and accept the Portal Terms and Conditions" and click "I Accept".
Proof logging: We log proof of acceptance (date/time, IP address, Terms version) for legal compliance and contractual traceability purposes.
UX: A modal displays at first login; a flag and acceptance logs are stored in our systems.
B.3 ACCOUNTS AND SECURITY
Login credentials are personal and non-transferable. Account sharing is strictly prohibited. Users must protect their access (strong password, credential confidentiality).
Security: We use Cloudflare Turnstile on the login form and log successful and failed connections (timestamp, IP, user-agent) for security and fraud detection purposes.
B.4 INFORMATION CONFIDENTIALITY
Portal information (prices, technical sheets, commercial documents) is confidential and reserved for strictly professional use by the partner. Any public redistribution or to unauthorized third parties is prohibited without written agreement from Westpoint.
B.5 AUTHORIZED / PROHIBITED USE
Authorized:
- Consultation of product information and prices
- Download for internal needs
- Preparation of orders and quotes
- Professional use in accordance with the partner relationship
Prohibited:
- Mass scraping or unauthorized automation
- Alteration or circumvention of security measures
- Public distribution of confidential content
- Sharing credentials or creating multiple accounts
B.6 AVAILABILITY AND SUPPORT
The Portal is accessible 24/7 except during scheduled maintenance periods. In case of technical incident, support available via [email protected] during business hours.
Limitation: No guarantee of uninterrupted availability is provided.
B.7 SUSPENSION / REVOCATION
Westpoint may suspend or revoke access in case of:
- Breach of these Terms and Conditions (credential sharing, illicit use)
- Compromise of system security
- End of commercial relationship
- Prolonged inactivity (more than 6 months)
The partner commits to inform us without delay in case of suspected compromise of their access.
B.8 PERSONAL DATA (B2B REMINDER)
Processing related to the Portal (account creation, connection logs, anti-bot) are described in the Privacy Policy – "Partner Portal" Annex. Purposes: contract execution & legitimate interest (security).
Indicative durations:
- Account: during relationship then archiving (up to 3 years max)
- Security logs: 6-12 months
- Support: 3 years after closure
B.9 INTELLECTUAL PROPERTY
Portal content (databases, product sheets, prices, documents) remain the exclusive property of Westpoint or their respective owners. No transfer of rights is made by accessing the Portal.
B.10 APPLICABLE LAW AND DISPUTES
Disputes relating to the Partner Portal are subject to French law. In case of disagreement, the parties will strive to find an amicable solution. Otherwise, the courts of Bordeaux will have exclusive jurisdiction.
FINAL PROVISIONS
ARTICLE 19 - MODIFICATIONS TO TERMS AND CONDITIONS (FINAL PROVISIONS)
The Publisher reserves the right to modify these Terms and Conditions at any time. Modifications take effect upon publication on the Site.
For the Partner Portal: partners will be informed of modifications by email or notification in the Portal, with a 30-day notice before taking effect.
ARTICLE 20 - ARCHIVING AND VERSIONING
The Publisher archives these Terms and Conditions with each modification and can provide a copy of previous versions upon written request. Each version is identified by a number and effective date to ensure traceability of regulatory and contractual changes.
